Rental Policy and Agreement

This agreement constitutes a contract between the Guest(s) named below and Skybox Chalet, LLC, d/b/a Lookout Mountain Vacation Rentals (LMVR). Lookout Mountain Vacation Rentals (herein referred to as LMVR) serves as the agent and representative of all owners of rental cabins and/or houses (herein referred to as Unit) in our rental program, and is acting at all times in and for the best interests of the property owner for the rented cabin.  Severability - if parts of the contract are held to be illegal or otherwise unenforceable, the remainder of the contract will still apply.

Security Deposit - A security deposit of $200.00 may be deposited with the Property Owner, or Property Owner’s designated agent (hereinafter referred to as “Owner”), in trust, as security for the performance by the guests of the terms under this rental agreement set forth following, and for any damages caused by guest(s), guests’  family, agents and visitors (hereinafter collectively called “guests”) to the premises or furnishings during the rental period. Owner may use part or all of the security deposit to repair any damage to the unit cause by guests. However, Owner is not limited to the security deposit portion of any security deposit amount and guest(s) remain liable for any balance. Deposit will be returned to the guest(s) credit card provided a satisfactory inspection of the Unit is completed after check-out and no damage is found other than normal wear and tear and no item(s) that belong to the Unit are missing. 

Damage insurance:  As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3000. Any damages that exceed $3000 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3000.  Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy www.vacationrentalinsurance.com/g20vrd The Vacation Rental Damage plan can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Skybox Chalet llc, any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Skybox chalet, llc directly if you do not wish to participate in this assignment. In the event you do not wish to purchase this plan, a $200 security deposit is required.

Occupancy - Guest(s) understand that LMVR will only accept reservations from responsible adults over the age of 25. Absolutely no exceptions. Guest(s) who initiates rental will remain responsible for all guest(s) or licensee of Guest(s) during occupancy of subject property. Occupancy is limited to REGISTERED GUEST(S) ONLY. Absolutely no overnight visitors, parties, weddings, rehearsal dinners, etc. are allowed without prior arrangements made in advance in writing to LMVR and agreed to in writing by LMVR management. AT NO TIME IS THE MAXIMUM OCCUPANCY OF THE PROPERTY TO BE VIOLATED. ABSOLUTELY NO EVENTS AND/OR HOUSE PARTIES. VIOLATION OF MAXIMUM OCCUPANCY IS STRICTLY PROHIBITED!

Cleaning Fees - The cleaning fee is base on a normal cleaning.  If you leave the property is extreme disarray and extra cleaning is needed you will be charge an additional cleaning fee. Delayed check-ins may occur during high season due to high volume turn arounds. LMVR will use all reasonable effort to have your cabin ready for guest occupancy at time of check-in.

Check-in/check-out times - Check-in is a self check-in and is at or after 4 pm, and check-out is self check-out and is any time prior to 11 am, both Eastern time.  All Unit(s) have either an electronic lock or a lockbox which holds the key. Please insure you lock the door behind you when you leave. There is a 15-minute grace period for check-out. If you depart the property after 11:15 am (Eastern time), another day’s rental charge may be taken out of the security deposit. If you would like an early check-in or a late check-out, please contact the office to see if this is possibility.

Check-out procedure - Check out time is 11 am (eastern standard time) 

As our Guests, we are not going to ask you to do a bunch of housekeeping chores as your vacation comes to an end.

Our only check out requirement is we ask you to please leave the property in as similar a condition as you found it and to secure the property.

LOCK THE DOOR:

1. Press the [SCHLAGE] oval button.

2. After hearing the ascending tone and while the [SCHLAGE] oval button flashing green light, please turn the lock knob within 5 seconds to lock the door.

If you would like to help out by loading and starting the washing machine with towels and loading and starting the dishwasher, that would greatly assist the cleaning crew and certainly would be appreciated.  You do not however have to do this.

Reservation requirements - 100% of the total rental fee plus a $200 deposit is due at the time of booking to confirm your reservation or you may purchase Damage Waiver Insurance in lieu of deposit. If you book online you have accepted this agreement - a signed reservation agreement is required to secure a reservation. LMVR accepts MasterCard, VISA, American Express and Discover. Cash and checks are not accepted.

Cancellation - All cancellations must be in writing to inquiry@cabinsofchattanooga.com (you must receive an acknowledgment of our receipt).  All rents, cleaning, taxes, and deposits will be returned minus a 10% administrative fee will be assessed for any cancellation or cabin/date change. However, if guest(s) cancels fewer than 30 days prior to the arrival date, there will be no refund of rents and fees other than the deposit.  No-shows - No refunds will be issued for no-shows or late-shows.

Travel Insurance Rental:  VACATION RENTAL INSURANCE - Guest Protect Plan CSA Vacation Rental Insurance has been offered with your reservation. Vacation Rental Insurance reimburses for pre-paid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation and force you to incur unplanned expenses. Refunds - or rate adjustments are not made for inconvenience due to construction noise, road repairs, mechanical failures, early departures, weather, snow, ice, road conditions, delayed arrivals or reducing the number of nights stayed with fewer than 30 days’ notice.  If you are concerned that you may not make your trip, we do recommend purchasing trip insurance at the time of booking or at least 30 days prior to your stay.

STORM POLICY/ROAD CONDITIONS (mountain property): No refunds will be given for storms. Mountain roads can be curvy and steep. Gravel drives are well maintained, however we do not refund due to road conditions; we highly recommend you purchase travel insurance.

Steep and Curvy driveways -  Some of the properties have steep and curvy driveways and some are not paved, use caution. In any present or recent inclement weather, use driveways at your own risk. 

Confirmation - Confirmation of reservation will be e-mailed to guest(s) immediately upon booking your reservation on-line. Please read the confirmation for accuracy of dates, mailing address, number of adults and/or children, animals and accommodation, sign and return. Note any errors immediately to LMVR. Please pay close attention to the dates and number of persons on the confirmation. Occupancy is limited to Maximum capacity of the unit and REGISTERED GUEST(S) ONLY. (Violation of maximum occupancy of any unit will be an automatic forfeiture of your deposit). This agreement also covers any nights added to the stay period after initial reservation.

Keys - At the SHED, the key should be returned to the lockbox and the lockbox should be locked. If a key is lost, the Guest(s) will be charged $100 for rekeying the lock(s).  All other properties have electronic locks, and you will be provided a personal code for use during your stay.

Television(s) - All Unit(s) are privately owned and have different subscription packages for TV channels. LMVR can not guarantee any programs or events. TVs and/or internet not working, or not getting a specific channel are not and will not be handled as an emergency or be grounds for a refund. 

Fireplaces, fire pits, fireworks - If you use an outdoor fire pit, you are responsible for any “wildfires” and could be subject to fines or response charges by the Department of Forestry. No fires are to be left unattended, either outside or inside. Fireworks are forbidden at all our properties.  If any evidence of fireworks is found, that will be immediate cause for us to retain your full damage deposit.

NO SMOKING - All cabins are NON-SMOKING (cigars, cigarettes, e-cigs, vapor) and this policy is strictly enforced. Smoking is allowed outside. Please do not litter with cigar or cigarette butts. If butts are found on the ground, an additional cleaning fee may be charged.

Alcoholic beverages - By Georgia and Tennessee law, no drinking of alcoholic beverages by persons under the legal age of 21 is allowed. Violation will be cause for immediate eviction with loss of all rent monies paid. EVENTS AND/OR HOUSE PARTIES and VIOLATION OF MAXIMUM OCCUPANCY AND ARE STRICTLY PROHIBITED.

Animals - Some Unit(s) are animal friendly. Please let us know if you are bringing an animal(s). There is an additional $35 (non-refundable) charge for the first animal and an additional (non-refundable) charge of $35 dollars for each additional animal. If you bring an animal and it is not listed on the reservation agreement, your immediate eviction and loss of all rents and security deposit may result. Animals are NOT allowed on furniture or beds and are to be crated in the guests absence. If your animal causes any DAMAGE, then you, the guest(s), will be responsible for any damage. 

Unit(s) furnishing and equipment - Unit(s) are privately owned with furnishings and equipment provided by the owner. LMVR cannot make changes to this. If you require special appliances or equipment, please bring them with you. Decor, style, color and themes will vary with each Unit. Furnishings are subject to change without notice. DO NOT rearrange the furnishings.  At any BLUFF PROPERTY, please do not leave any items unattended outside on the decks as they often experience high winds. Any damage caused by unattended items will be charged to the guest of record. 

Decks and Porches - All have decks with railings. DO NOT CLIMB OR SIT ON THE RAILINGS! Stay on the decks, do not venture to the edge of the mountain or to the edge of the river. Bluff and River Properties Especially - If you or anybody in your party venture off the deck, to the edge of the mountain or to the edge of the river, you/they do so AT YOUR/THEIR OWN RISK. CHILDREN AND PETS SHOULD BE SUPERVISED AT ALL TIMES.   Note: “THE SHED”  interior stairs to the loft/bedroom are a bit steeper than normal stairs, use both handrails.

Critters - Deer, coyote, bear, turkey, possum, horses, dogs, raccoons, ladybugs, carpenter bees, wasps, scorpions, tick, ants, chiggers, snakes, poison ivy/oak etc... may be encountered in the wilderness areas. There is no refund for the presence of wilderness creatures and vegetation.

Inside Critters - all properties are treated periodically for pests.  Please do not leave any food out as this will attract uninvited pests. Our properties are designed to be pest-free, and we appreciate your cooperation.

Linens - All Unit(s) provide linens, towels, blankets and pillows. These items are not changed during your stay. The Unit(s) owners will supply your initial supply (1 to 2 ) days of paper products, soap, trash bags etc...for your convenience. If you need more, please bring your own.

Unit description and rates - Information regarding all cabins is believed to be accurate but cannot be guaranteed. The possibility of errors and omissions still exist. Rates, furnishings, fees and taxes are subject to change without notice. All Units have a two-night minimum stay. 

Owners’ closet - Most Unit have a closet that is locked.  Please do not disturb this closet. 

Taxes, fees and cleaning costs -  and pet fees are in addition to the rental booking amount.

Hot Tubs - USE AT YOUR OWN RISK! Please observed and follow the posted rules signs.  Do not use the hot tub if you are or if you suspect you are pregnant. Children must have adult supervision. No bubble bath, salts or soaps of any kind are allowed in the hot tub. Please do not sit on the covers. Guest(s) should shower prior to using the Hot tub. Drinking containers, bottles, glasses, cans, smoking and animals are strictly prohibited. If, evidence is discovered to the contrary, a fine of $100 will be charged to the responsible guest(s) of record. LMVR can not guaranteed against mechanical failure of hot tubs, either prior to your arrival or during your stay.

Repairs, service calls - LMVR cannot guarantee against mechanical failure of heating, A/C, hot tubs, TV’s, DVD, WIFI, modems or other appliances. Please report any malfunctions to LMVR as soon as possible.  We will make every effort to resolve the problem as quickly as possible. If a repair person makes a call to the Unit and the problems was due to the guest(s) oversight or neglect, the charge for the service will be the guest(s) responsibility. Repair persons may need access to the cabin to make the repair.

Termination by owner/Unit substitutions - LMVR strives to comply with all requests. However, due to uncontrollable circumstances, such as changes in property ownership, properties being removed from the rental program, mechanical problems etc. we cannot guarantee a specific Unit. LMVR reserves the right to change your Unit without notice or liability should the Unit become unavailable. LMVR shall not be liable for events beyond their control which may interfere with your visit, including but not limited to acts of God, acts of governmental agencies, fire, war, etc.

Lost and found - Any personal item left in the Unit can be mailed to a US Address on request for a fee of $20. We will charge your credit card and put the receipt in the package. Any items left more than seven (7) days will be donated to charity.  

HOLD HARMLESS AND INDEMNIFICATION - Guest(s) agree to hold harmless and indemnify the owners and LMVR for any liabilities, damage, theft, expense or costs arising from or related to any litigation or claim which may arise out of, or in connection with guest(s) occupancy and use of the rental property. This is including, but not limited to, any liability or claim for personal injury or theft or damage of personal property that is made, incurred or sustained by guest(s). The terms “OWNER” and LMVR are used in agreement and shall include  their successors, assigns,heirs, employees, agents and representatives where the context requires or permits. The term guest(s) and licensee of guest(s), successors, assigns, heirs, guests, invitees, representatives and other persons who happen to be on the rental property during guest(s) occupancy (without regard to weather such persons have authority under this agreement to be at the rental property), where the context permits or requires.  LMVR is liable to the guest only for the amount of the total rental fee plus deposit, if any.

LMVR reserves the right to refuse service to anyone. All rental cabins are leased without regard to race, color, religion, sex, national origin, familial status or handicap. GUESTS MUST BE RESPONSIBLE AND OVER THE AGE OF 25.

Denying payment - Should LMVR have to obtain legal advice of counsel for any matter arising from any payment discrepancy involving a guest(s) or payment vendor such as credit card companies. LMVR legal counsel will seek rightful collection or payment for LMVR on behalf of the owner. If disputes are transferred from LMVR’s management to a collection agency, responsible guest(s) of record will be liable for all incurred charges proved to be their responsibility in a court of law. 

 

Disputes - This agreement shall be governed by and interpreted in accordance with the laws of the state of Georgia and shall be treated as though it were executed in Dade County, GA. Any action whatsoever in relation to this agreement shall be instituted and prosecuted only in Dade County, GA Superior Court, Georgia. Guest(s) specifically consents to such jurisdiction and to extraterritorial derive of process.  LMVR is only liable for the total rental fee paid plus deposit, if any.

By having booked online and having accepted this policy, I attest that I am over the age of 25 and I am providing my credit card number as a guarantee. I agree to pay all rent, accept all terms of this reservation agreement and accept all liability for any damage, including animal damage, beyond normal wear and tear during the term of my agreement with Skybox Chalet LLC. If I fail to do so, I understand any fines or damages will be charged to my credit card and all credit card sales are final.
